TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the Nite mobile application, this website, and related services (the "Services") operated by Nite ("we," "us," or "our"). By downloading, accessing, or using Nite, you agree to these Terms.

If you do not agree, do not use the Services.

1. THE SERVICES

Nite is a bedtime alarm that helps you end the day. It can interrupt you at a time you choose, guide a Get Into Bed check, then start a wind-down (guided breathing, body scan, progressive muscle relaxation, or sleep sounds) and a goodnight close. Optional tools may include on-device app blocking and sleep ambience.

Nite is for personal wellness only. It is not a medical device, sleep clinic, or diagnostic tool. It does not provide medical, mental health, or other professional advice, and it does not treat insomnia or any condition. Always use your own judgment and consult a qualified professional if you have concerns about sleep or health.

2. ELIGIBILITY

You must be at least 13 years old to use Nite. If you are under the age of majority where you live, you may only use the Services with the consent of a parent or legal guardian who agrees to these Terms.

3. ACCOUNTS

You may need an account to use certain features. You are responsible for:

Providing accurate account information
Keeping your Apple or Google account secure (Nite uses those providers for sign-in)
All activity that occurs under your account

Notify us promptly at appbros761@gmail.com if you suspect unauthorized access.

You may delete your account from the Profile tab in the App, or by contacting us. Account deletion removes the account and associated Nite data stored in Supabase, subject to the Privacy Policy and any retention required by law. It does not cancel an active App Store or Google Play subscription; cancel that subscription through Manage Subscription in Nite or your store account settings.

4. FREE ACCESS AND SUBSCRIPTIONS

Nite may offer an introductory trial or another access period shown in the App at the time of purchase. Continued use of Premium features requires an active Premium subscription.

Paid subscriptions are billed through the Apple App Store or Google Play, and managed by those platforms (and related processors such as RevenueCat). Pricing, billing periods, trials, and renewals are presented at purchase and controlled by the applicable store.

For Apple App Store purchases:

Payment is charged to your Apple ID at confirmation of purchase
Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period
Your Apple ID is charged for renewal within 24 hours prior to the end of the current period, at the price shown in the App
You can manage or cancel in iOS Settings → Apple ID → Subscriptions, or from Manage Subscription in the App
Any unused portion of a free trial is forfeited if you purchase a subscription during that trial

For Google Play purchases, billing, renewal, and cancellation follow Google Play’s subscription terms.

Refunds, if any, are handled under the store’s refund policies
We do not store your payment card details

5. LICENSE AND ACCEPTABLE USE

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Nite for your own non-commercial purposes, subject to these Terms.

You agree not to:

Copy, modify, distribute, sell, or reverse engineer the Services
Interfere with or disrupt the Services or other users
Attempt to access data or accounts that are not yours
Use the Services for any unlawful purpose
Abuse Get Into Bed verification (including flooding checks or submitting stills that are not your own bedtime check)
Upload content that is illegal, harmful, or infringes others’ rights

We may suspend or terminate access if we reasonably believe you have violated these Terms.

6. USER CONTENT AND GET INTO BED

You may create or store content such as bedtime schedules, wind-down preferences, onboarding answers, and night follow-through records ("User Content"). You retain ownership of your User Content.

You grant us a limited license to host, store, process, and display User Content solely as needed to operate the Services for you.

Get Into Bed. If you run a Get Into Bed check, you grant us a limited license to process short-lived camera stills solely to verify that you appear to be lying in bed, including by sending them to Google Gemini for that request. Nite does not keep those stills as part of your account after the check. Google's handling is governed by its applicable terms and privacy policy. You are responsible for only capturing stills you have the right to use, in a setting where you are allowed to use the camera.

You are responsible for User Content you submit. Do not upload content you do not have the right to use.

7. INTELLECTUAL PROPERTY

The Services, including design, text, graphics, software, audio, companion characters, and trademarks, are owned by Nite or its licensors and are protected by intellectual property laws. Except for the limited license above, no rights are granted to you.

8. THIRD-PARTY SERVICES

Nite relies on third-party providers for hosting, authentication, subscriptions, app updates, optional push-token registration, website support email, and Get Into Bed verification (including Supabase, Apple, Google, Gmail, RevenueCat, Expo, and Google Gemini). Your use of those services may be subject to their terms and privacy policies.

Optional app blocking uses Apple Screen Time / device-activity features (and comparable platform tools where available). Those features are governed by the platform’s rules and permissions. We do not guarantee that every app can be blocked on every device.

9. DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation, that Get Into Bed verification will always succeed, that alarms will fire in every system state, or that using Nite will produce any particular sleep outcome.

Alarms and notifications depend on the operating system, Focus modes, battery settings, and permissions you grant. Keep those permissions enabled if you want Nite to interrupt you at bedtime.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NITE AND ITS AFFILIATES, OFFICERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the fullest extent permitted.

11. INDEMNITY

You agree to defend, indemnify, and hold harmless Nite from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.

12. CHANGES

We may update these Terms from time to time. The updated version will be indicated by a revised "Last updated" date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

13. TERMINATION

You may stop using Nite at any time. We may suspend or end access to the Services if you violate these Terms or if we discontinue the product. Provisions that by their nature should survive will survive termination.

14. GOVERNING LAW

These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise.
